it&#039;s much worse than that, Eretaz rejects the vast majority of the hadiths sahih or otherwise and believes in his words of &quot;following the sunnah in the manner of Imam Malik, from the practice of the people of Madinah&quot; telling him that Imam Malik was also the pioneer of muhadditheen doesn&#039;t seem to register with him though.

Also with regards to this issue of ijtihad, after a long discussion with one of my Shuyukh i am of the opinion it is better not to talk of fresh ijtihad but rather talk of the work of the Faqih in giving a judgment on a new issue according to the usul of his madhab. The reason being that although essentially the Faqih is a type of mujtahid, the terms mujtahid and ijtihad can imply to many the idea of the highest type of ijtihad i.e. deriving a methodology- an usul from the sources. That was after all the meaning of the closing of the doors of ijtihad was about- the restriciting of usuls to the four schools.
